By accessing or purchasing from KIV Shop, you agree to these Terms and Conditions. If you do not agree, please do not use this website.

1) About KIV Shop

KIV Shop provides technology products and related solutions intended to support senior independent living, communication, reminders, safety, and wellbeing.

2) Eligibility

You confirm that you are at least the age of majority in your province/territory and legally able to enter into a binding agreement.

3) Product Information

We make reasonable efforts to ensure product descriptions, images, and pricing are accurate. However, minor differences (including packaging, color tone, software version, or accessory updates) may occur.

KIV Shop may update, discontinue, or modify products and pricing at any time without prior notice.

4) Orders and Acceptance

All orders are subject to acceptance and availability.
After placing an order, you will receive an order confirmation email. This confirmation does not guarantee final acceptance. KIV Shop reserves the right to cancel or refuse any order for reasons including, but not limited to:

  • Product unavailability

  • Pricing or listing errors

  • Suspected fraud or unauthorized transaction

  • Incomplete shipping or billing information

If payment was collected for a cancelled order, the amount will be returned through the original payment method where applicable.

5) Pricing, Currency, Taxes

All prices are listed in [CAD/USD – choose one] unless otherwise stated.
Applicable taxes and shipping fees (if any) are calculated at checkout.

You are responsible for any customs duties, import fees, brokerage fees, or local taxes for international shipments.

6) Payment Terms (PayPal)

KIV Shop processes payments through PayPal. By placing an order, you agree to:

  • Use a valid and authorized payment method

  • Be bound by PayPal’s user agreement, terms, and privacy policy

  • Complete payment at checkout before order processing begins

KIV Shop does not store full payment card details. Payment authorization, fraud checks, and transaction handling are managed by PayPal and its payment infrastructure.

7) No Return / No Refund Policy

All sales are final.
KIV Shop operates a strict No Return and No Refund policy.

By purchasing from KIV Shop, you acknowledge and agree that:

  • Products are non-returnable

  • Payments are non-refundable

  • Exchanges are not guaranteed and are only considered at KIV Shop’s sole discretion where required by applicable law

8) Damaged, Defective, or Incorrect Items

If you receive an item that is damaged in transit, defective on arrival, or materially different from your confirmed order, contact us within 48 hours of delivery at [Insert Email], including:

  • Order number

  • Photos/videos of packaging and product

  • Description of the issue

KIV Shop will review each report and determine resolution options in line with applicable law and manufacturer policies.

9) Shipping and Delivery

Delivery timelines are estimates and not guaranteed. Delays may occur due to courier issues, customs clearance, weather, holidays, or supply chain events.

Risk of loss transfers to the customer upon delivery confirmation to the shipping address provided at checkout.

Please ensure your shipping information is accurate. KIV Shop is not responsible for delivery issues caused by incorrect addresses submitted by the customer.

10) Warranty and Third-Party Products

Some products may include a manufacturer warranty. Unless explicitly stated, KIV Shop does not provide additional warranties beyond those legally required.

For third-party brands sold through KIV Shop, warranty service (if available) may be handled by the manufacturer or authorized distributor.

11) Intended Use and Safety

Products are intended for lawful, appropriate, and intended use only.
KIV Shop products are not a substitute for emergency services, medical diagnosis, or professional clinical care unless explicitly identified and approved as such.

Always follow the user manual and safety instructions.

12) Intellectual Property

All content on this website (including text, logos, graphics, images, product copy, and design elements) is owned by or licensed to KIV Shop / KIV.TECH and is protected by intellectual property laws.

No content may be copied, reproduced, republished, or distributed without prior written permission.

13) Privacy

Your use of KIV Shop is also governed by our Privacy Policy.
By using this website, you consent to collection and processing of information as described in that policy.

14) Limitation of Liability

To the maximum extent permitted by law, KIV Shop and its affiliates, directors, officers, employees, and partners are not liable for indirect, incidental, special, or consequential damages arising from:

  • Use or inability to use products/services

  • Delays or interruptions

  • Third-party payment processor issues (including PayPal platform outages)

  • Incorrect use of products by the customer

Total liability, where legally applicable, is limited to the amount paid by the customer for the specific order.

15) Indemnification

You agree to indemnify and hold harmless KIV Shop / KIV.TECH from claims, losses, liabilities, and expenses arising out of your misuse of the website, breach of these Terms, or violation of law.

16) Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, unless otherwise required by mandatory consumer protection law.

Any disputes shall be subject to the courts of Ontario, Canada, unless applicable law provides otherwise.

17) Changes to Terms

KIV Shop may update these Terms at any time. Updated terms are effective upon posting to the website with a revised Effective Date. Continued use of the website indicates acceptance of revised Terms.

Hygiene & Safety — Final Sale Once Opened
For hygiene and infection control reasons, this product is a final sale once the packaging has been opened or the product has been used. We cannot accept returns or exchanges of opened/used items.

If your item arrives damaged, defective, or incorrect
If your order arrives damaged, defective, or different from what you ordered, we will make it right. Please contact us at info@kiv.tech within 7 days of delivery and include:

  • Your order number
  • A brief description of the issue
  • Clear photos of the item and the packaging (including any damage)

After review, we will provide an appropriate resolution, which may include a replacement, refund, or store credit, depending on the situation.

Unopened / Unused items (sealed packaging only)
If the item is unopened, unused, and in original sealed packaging, you may request a return within 7 days of delivery. Items must be returned in resalable condition. Return shipping costs may apply unless the item is defective or incorrect.

  • Do not send items back without contacting us first; we will provide return instructions if your request is approved.

Shipping Policy (Canada) — Kept In View (KIV)

Kept In View (KIV) operates KIV Shop (“we,” “our,” “us”). This Shipping Policy applies to orders shipped within Canada.

1) Where we ship

We currently ship within Canada.

If a shipping method does not appear at checkout for your address, it may mean:

we do not ship to that location yet, or

the item is restricted due to size/handling requirements.

2) Processing time

Orders are typically processed within 1–3 business days after payment is confirmed (excluding weekends and statutory holidays).

Processing time may be longer during:

promotions and high-volume periods,

product launches/pre-orders,

events/exhibitions.

3) Shipping methods & delivery estimates

Delivery times begin after your order is processed and shipped.

Typical delivery estimates (Canada):

Ontario: ~1–5 business days

Other provinces/territories: ~3–10 business days

Remote areas: may take longer

Delivery estimates are not guaranteed and may be affected by weather, carrier delays, or peak seasons.

4) Shipping rates

Flat rate shipping: $15 CAD

5) Tracking

If tracking is available for your shipment, we will email you a tracking number once your order ships.

Some low-cost shipping methods may have limited tracking.

Policy myabilia product

Third-Party Services (myAbilia / Abilia Apps).
Some products sold on KIV SHOP may work with Abilia’s online services (including “myAbilia”) and/or Abilia mobile applications. These services are provided by Abilia (not KIV SHOP). KIV SHOP does not create, host, operate, or manage myAbilia accounts, and we do not control how Abilia processes personal information in myAbilia.
If you choose to use myAbilia or Abilia apps, your relationship is directly with Abilia and is governed by Abilia’s Terms and Privacy Policy. Abilia states that myAbilia services are hosted in the EU and that data communications are encrypted (SSL/TLS).
KIV SHOP is not responsible for:

(a) the availability of myAbilia/app services,

(b) data storage/processing in those services, or

(c) any outages, account issues, data loss, or security incidents related to those services.
Abilia’s published security information also notes that a minimum of data may be shared with third parties located in the US for parts of its services.

KIV SHOP does not receive or access the information you upload or create in myAbilia (including user-generated content) unless you separately choose to share it with us (for example, when requesting help from KIV SHOP). Account creation and use of myAbilia is handled by Abilia.

Our collection and use of personal information for purchases and customer service is described in the KIV SHOP Privacy Policy. We may use service providers (for example, e-commerce hosting, payment processing, shipping, and analytics). Some providers may process information outside Canada. We remain responsible for personal information in our custody or control and use contractual or other means to provide a comparable level of protection when using service providers.

Geographic Availability (No Sales to Québec).
KIV SHOP does not offer sales or shipping to addresses in Québec. Orders with a Québec shipping address (or that we reasonably believe are intended for delivery into Québec) may be cancelled and refunded.

Manufacturer Warranty & Support.
Unless expressly stated otherwise, products are covered by the manufacturer’s warranty. myAbilia/app account support is provided by Abilia. KIV SHOP may assist with basic product-sales questions (order status, returns), but we do not provide technical support for Abilia’s online services.
